The Masri Case

Recent developments: The global settlement agreed by the parties in September 2011 led to the official discontinuation of the Greek proceedings in November 2011. KLC Law Firm acted for Mr. Munib Masri, working closely with his lead counsels, the international law firm Simmons and Simmons LLP, in the Greek leg of a multijurisdictional litigation against legal entities and persons of a well-known international construction group with offices, amongst others, in Greece. The Greek leg of the said litigation lasted approximately 3 years until settlement and mainly involved the enforcement of English judgments in Greece. KLC Law Firm developed and implemented the strategy to enforce the English court judgments in Greece, while it also provided, when needed, legal opinions on the Greek law position in combination with EU law in the context of proceedings in other jurisdictions. Greek proceedings were innovative under Greek law and were supported by the opinions of some of the leading Greek legal academics. The case generated landmark court judgments which have been commented in Greek legal press. The developments of the Masri litigation in Greece also gained interest of the Greek press, while the overall case history gives a definitive guide on multi-jurisdiction enforcement. The KLC team, handling the above case since 2008, comprises Kostas Loukopoulos, Panagiotis Tzioumas, Sotiria Sigalou, Alexandros Tsirigos and Theodoros Loukopoulos. Andrew Bartlett of Simmons & Simmons LLP (lead international counsel for Mr Masri), commented that “KLC have been an essential part of the international enforcement proceedings and have been instrumental in helping to devise an innovative strategy in this highly complex litigation”.
